Contest Rules and Regulations

General

The “Find the Golden Present Contest 2023” is operated by Immaculate Confection LTD (the “Sponsor”), any individual participating in the contest will be referred to as the “Entrant”. By entering the contest, the entrant acknowledges that he/she/they a in compliance with these rules and regulations and agrees to be bound by the Privacy Policy herein (see section 7).

Eligibility

The Contest is open to any individual who has reached the age of majority in their Province or Territory of residence.

Individuals in any of the following categories are NOT eligible to participate or win prizes in this Contest: (a) any person who, at any time on or after November 12th, 2023, was or is a director, officer, employee, or agent of Rocky Mountain Chocolate or Immaculate Confection LTD, or any of its prize suppliers, or any of their respective divisions, parent, subsidiary, or affiliated companies, franchisees, or service agencies, or independent contractors; and (b) any person who, at any time on or after November 12th, 2023, was or is a director, officer, employee, or agent of any company involved with the administration of the contest or any individuals engaged in the development, production or distribution of materials for the Contest (collectively the “Contest Entities”); and (c) any person who is an immediate family member of, or domiciled with, any of the above.

Contest Period

The contest begins at the opening hour of the Rocky Mountain Store on November 12th, 2023. Hours of operation may vary between stores across Canada. The contest ends at the closing time of the Rocky Mountain Chocolate Stores on December 24, 2023. Closing time of operations may vary between stores across Canada.

The contest is limited to the stock held at the Rocky Mountain Chocolate Stores. If all the participating items run out before the ending date of the contest, the signage will be taken off and the contest considered over at the concerned location.

The head office factory outlet participates in the contest. No outlet promotions will be applicable on the items included in the contest.

How to enter the contest

4.1 Participating stores

Rocky Mountain Chocolate stores participating in the Rocky Mountain Chocolate “Find the Golden Present Contest 2023” contest will display Rocky Mountain Chocolate “Find the Golden Present Contest 2023” contest signage. All the stores across Canada will participate in the contest, with the exception of any stores located in the province of Quebec. The quantities of participating products and the chances of winning may vary per store.

4.2 Ways of entering the contest

There is no purchase necessary to enter the contest. There are two (2) ways of entering the contest:

(1) The Entrant must send a letter to Immaculate Confection’s headquarters located at 5284 Still Creek Ave – V5C 4E4, Burnaby, BC, Canada by the end of the contest on December 24, 2023 5:00pm PST. The letter has to be manuscript and contain a minimum of fifty (50) words and detail what Rocky Mountain Chocolate inspires to the Entrant. The letter has to contain all the information necessary for the Sponsor to reply – complete Address of the Entrant, first name and family name. If the letter does not comply with the above information, the Entrant will not be entitled to any prize and the Sponsor will not be obligated to answer the Entrant to notify the failure to enter the contest. The Entrant can only submit one letter. In case the letter is compliant with ALL of the above instructions; Rocky Mountain Chocolate will send the Entrant a Rocky Dollar Card, of 10 dollars. The distribution of these amounts is highlighted in section 5 prize “value and odds of winning”. The Entrant will receive an answer within fourteen (14) business days after the ending date of the contest.

(2) Purchase a participating product in a participating Sponsor’s store location to enter the contest. In case of participation with purchase, the participant must purchase a participating item (as listed in section 4.4). 10 (ten) participating items will contain a Rocky Dollars Card of different values placed inside the item according to the prize and odds of winning detailed in section 5. The values of the Rocky Dollars Cards vary. All values will be printed directly on the cards.

4.3 Restrictions of Entry

There are no restrictions on the number of participating items that can be purchased during the contest period. Entrants entering the contest by sending a letter may only submit one letter per individual.

4.4 Participating items

Only participating items as listed below and advertised on promotion signage within Rocky Mountain Chocolate store locations are subject to the “Find the Golden Present Contest 2023” contest rules. All the other items displayed in the store follow the Sponsor’s regular sales conditions. The contest is limited to the stock every store carries, once all the participating items have been sold, the contest in the store is over.

Prizes and Odds of Winning

5.1 Prize description

Prizes given away by the sponsor are Rocky Dollars Cards containing different values (as listed in section 5.3). The prizes can only be used in Canadian Rocky Mountain Chocolate stores. The Rocky Dollars Cards value will be displayed on the card. Prizes cannot be converted into cash. The utilization of the Rocky Dollars Card awarded as a prize is similar to any card distributed by the Sponsor according to the Sponsor’s Sales Policy, with the exemption that they have an expiration date of December 24^th, 2024.

5.2 Prize Population

Before the contest, the sponsor credited 10 Rocky Dollars Cards specifically designed for this contest. Some Rocky Dollars Cards will be kept at the sponsor’s headquarters for a second way of contest entry. The odds of winning will be the same as for the second way of entry. The number of cards awarded will then depend on the number of letters received.

Customers can win either a $100 Rocky Card, a $200 Rocky Card, a $1,000 Rocky Card or a $10 Rocky Card. The value can be redeemed only by contacting the Rocky Mountain Chocolate Head Office in Canada. Only one item holds the grand prize, and all winners must contact Rocky Mountain Chocolate Head Office to validate their prize, a physical Rocky card will then be mailed out containing the value associated with the winning entrant card found inside the “Find the Golden Present” Santa.

5.5 Using the price

Prizes can be claimed in ANY Rocky Mountain Chocolate store across Canada, with the exception of any stores located in the province of Quebec.

The value will be awarded to the carrier of the Rocky Dollars Card. It is not the Sponsor’s responsibility to verify that the carrier of the card is the “Winner” of the contest. No claim can be made by any individual not in possession of a prize. ALL other documents (i.e.: purchase receipts or manuscript letters) will NOT grant a prize. There is a limit of time for the winner to use the Rocky Dollars Card in any Rocky Mountain Chocolate store.

All such prize claims must be claimed by the end of the business day on or before February 1st, 2024. Claims received after February 1st, 2024 will be null and void and ineligible for prizes. Unclaimed prizes will not be awarded. If any prize notification or any prize is returned as undeliverable, the prize will be forfeited.

5.5 Contest-related complaints administration

Any issues or complaints related to the contest should be reported to the Sponsor’s headquarters as per the information below. Rocky Mountain Chocolate Stores are not responsible for the Find the Golden Present Contest 2023 - Administration.

General rules

The Prize must be accepted as awarded. No cash alternatives, substitution or transfers of the Prize will be allowed. The Sponsor reserves the right to substitute a prize of equal or greater value, or the equivalent cash amount, if the prize described is unavailable due to circumstances beyond their control. Under no circumstances will the Sponsor or any of the Contest Entities, or their respective directors, officers, employees, agents, divisions, parents, subsidiaries, affiliated companies, franchisees, service agencies, or independent contractors be required to award more Prizes than what is indicated in these Rules (section 5.3) or award the Prizes other than in accordance with these Rules (section 5.4).

The Contest is subject to all Federal, Provincial and local laws, as well as the rules adopted because of said laws. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of the Entrant and the Sponsor and/or the Contest Entities in connection with the Contest, shall be governed by, and construed in accordance with, the substantive laws of the Province of British Columbia without regard to British Columbia conflicts of law principles. All Entrants consent to submit any dispute arising from these Rules to the exclusive jurisdiction and venue of the Courts of the Province of British Columbia, region of Vancouver.

Privacy Policy

The Sponsor warrants that it will only use the personal information collected through the Contest as per this Privacy Policy, and will treat all personal information with the utmost care.

By entering the Contest, the Entrant agrees to the use of your personal information as described in this Privacy Policy. The personal information collected about you is limited to the information you have voluntarily supplied to the Sponsor.

Except as provided herein, the Sponsor will not divulge any personal information gathered through the Contest to third parties. Moreover, the Sponsor will not sell any personal information collected.

The personal information collected will only be used for the following purposes:

(i) use of the winning Entrants’ information;

(ii) administration of the Contest on an as-needed basis and publication of the winner’s name and or picture on social media.

Not with standing anything in this Privacy Policy to the contrary, we may share any information we have collected about you: (i) in response to subpoenas, court orders, or legal process, or to establish, protect, or exercise our legal rights or defend against legal claims or demands; (ii) if we believe it is necessary in order to investigate, prevent, or take action regarding illegal activities, fraud, or situations involving potential threats to the safety of any person; (iii) if we believe it is necessary to investigate, prevent, or take action regarding situations that involve abuse of the website infrastructure or the Internet in general; (iv) to a parent company, subsidiaries, joint ventures, or other companies under common control with the Sponsor and / or the Contest Entities (in which case we will require such entities to honor this Privacy Policy); and (v) if the Sponsor and / or the Contest Entities is acquired by or merged with another entity (in which case we will require such entity to assume the obligations under this Privacy Policy).

Despite efforts to ensure third parties will not access or obtain your personal information, complete confidentiality and security cannot currently be guaranteed on the Internet. Communication via the Internet is subject to interception, loss, or alteration. The Entrant acknowledges and agrees that the Sponsor cannot be held responsible for damages resulting from the transmission of confidential information or personal information over the Internet and that such communications are at your own risk.
